Skills In Demand (SID) Visa

The 482 SID Visa replaces the TSS Visa (Subclass 482) effective since December 7, 2024 but keeps its visa category number. It’s divided into three streams:

Specialist Skills Stream
- For jobs paying $135K+ (indexed annually), for example, in some instances an applicant may be able to apply under the Specialist Skills Stream of the Skills in Demand Visa, which does not require an occupation to be on a list.
- Excludes trades, drivers, and labourers.
Core Skills Stream
- For jobs paying $73,150+ (same as TSMIT for the old TSS Visa).
- Occupation must be on the new Core Skills Occupation List (CSOL), consolidating old lists like STSOL and MLTSSL.
Labour Agreement Stream
- Follows the TSS Visa rules for now until the Essential Skills Stream is finalised.

Key Changes:

Reduced Work Experience: Now just 1 year (was 2 years) which can be full-time or a pro-rata combination of part-time and casual work. Note, 1 year of work experience won’t substitute qualification. You still need to demonstrate that.
Available under Subclass 186 TRT after 2 years of paid, full-time, sponsored work.
Workers can switch employers within 180 days and have up to 365 days total across the visa period to find a new sponsor or visa.
English level, you must have an English proficiency level of at least 5 in each band for IELTS or 36 in each band for PTE.
English level for the specialist stream is minimum 6/6/6/6 or 50/50/50/50.
You must upload the proof of having obtained an health insurance at time of application;

What if you applied for a 482TSS before December 7?

TSS Visa applications made before 7 December 2024 will be processed under TSS Visa legislation. Applications made after this date are processed under the new SID legislation.

What if you applied for a 482TSS before December 7 but now your application is not on the list?

You could still be able to apply for a 186TRT as long as all criteria are met. However, if you lose your job or your employer won’t proceed with a 186TRT, you would need to search for other options.

Core Skills Occupation List (CSOL) and Caveats

This new list features 456 occupations, replacing the old lists (STSOL, MLTSSL, ROL). Removed occupations: several agricultural, arts/creative, finance, laboratory, health, social/welfare, hospitality/retail and sports occupations were removed such as:

Beef Cattle Farmer, Crop Farmers (nec) and Livestock Farmers (nec)
Conference and Event Organiser, Dancer or Choreographer and Graphic Designer
Financial Brokers nec, Financial Dealers nec and Economist
Medical Laboratory Scientist, Medical Laboratory Technician and Pathology Collector \ Phlebotomist
Chiropractor, Emergency Service Worker and Nurse Manager
Welfare Centre Manager and Child Care Centre Manager
Cafe or Restaurant Manager and Customer Service Manager
Footballer, Jockey and Sportspersons nec

Added occupations: some key occupations such as Cyber Security Analyst, Travel Consultant, and Child Care Worker and more.

While ANZSCO categories are used in the CSOL, the Government plans to transition to OSCA (Occupation Standard Classification for Australia) categories – a new system for classifying occupations.

The CSOL currently has 16 caveats that apply to specific occupations. Some caveats limit the use of a particular occupation under certain work circumstances. Others, such as Caveat 14, were included as a result of an International Trade Obligation (ITO).

There has been some confusion on how Caveat 14 applies to chefs. While Caveat 14 in the CSOL states: ‘The position is not provided for under an International Trade Obligation’, the Department of Home Affairs has clarified with the Migration Institute of Australia (MIA) that they do not intend for this caveat to limit the use of the chef occupation to countries where Australia has an ITO in place.

According to the MIA, the Department will seek to amend the legislative instrument to clarify this and in the meantime, it will not prevent applications of Chefs being lodged or granted on the basis of nationality.
